State Wants Injunction on Abortion Law Lifted

(KCPW News) A federal judge placed an injunction on Utah's partial birth abortion ban in 2004, but now the state Attorney General's Office is asking the injunction to be lifted.

The injunction was placed on Utah's ban when the Planned Parenthood Association and the Utah Women's Clinic filed suit against the state. Last month, the U.S. Supreme Court ruled that the 2003 Partial Birth Abortion Ban is not a violation of constitutional rights. Utah Assistant Attorney General Jerrold Jensen doesn't know if the abortion rights groups will fight the lifting of the injunction, but says he doesn't think they have any leverage following the Supreme Court ruling.

Should the injunction be lifted, the law would immediately take effect. Jensen anticipates the injunction will be lifted. He says the legal process to lift the injunction will take at least 30 days.
